What happens every week

Eight things get done, every single visit.

Not a quick skim and a handful of tabs. Here is the full checklist your tech works through before leaving the property.

Test and balance the waterChlorine, pH, alkalinity, stabilizer, calcium hardness
Brush walls, steps and tile lineWhere algae starts before you can see it
Net the surface and floorPlus vacuum whenever the pool needs it
Empty skimmer and pump basketsThe single most skipped step in this business
Check filter pressureRising pressure gets flagged to you early, before it costs you a pump
Eyes on the equipment padLeaks, noise and pressure noted and reported to you
Add all chemicalsIncluded in your monthly rate, never billed extra
Send your service reportReadings, chemicals added and photos, texted to you
Where we run

A tight route, on purpose.

We keep the route close to home so nobody gets squeezed for time at the end of the day. If you are inside these areas, we can usually add you within a week.

We carry commercial insurance for the work we do, including general liability. Ask us for a current certificate any time and we will send it over. No hedging, no runaround.

Certified techs, every week

Every visit is performed by a CPO certified technician who knows your pool, your gate code and your dog. Nobody is guessing at your water, and nobody is a stranger in your backyard.

Cancel whenever

Month to month, no sign up fee, no cancellation fee. We would rather earn the next month than lock you into it.

We stay in our lane

We are a cleaning and water care company, not a pool contractor. When something needs a repair we flag it in writing and hand you to a licensed contractor we trust. You hear it from us the same day we see it.

Certified Pool Operators on every accountBoth owners hold the CPO certification from the Pool and Hot Tub Alliance. Your water is handled by someone trained in it, not someone guessing at tabs. CPO is a water care certification and is separate from a Florida contractor license, which we do not hold and do not need for cleaning.

Services

Weekly service, plus everything that comes up in between.

Most customers start with weekly service and never need anything else. We handle cleaning and water care. Repairs go to a licensed pool contractor, and we tell you the day we spot one.

Weekly full service

The core plan. Chemicals, cleaning, equipment checks and a service report, every week, all year. Nothing to buy, nothing to remember.

Corrective treatment

Sometimes water goes off for a reason that is not the weather: the pump was off, the level dropped, somebody else added chemicals. Bringing it back takes more than a normal dose. We show you the readings, tell you what it costs, and only start once you say go.

Green pool recovery

Pool went swamp on you? We shock it, run the filter hard and keep coming back until it is swimmable. Usually three to seven days depending on how far gone it is. If it turns out the pool has to be drained, that is a licensed contractor job and we will point you to one.

Filter cleans

Cartridge and DE filters broken down, deep cleaned and reassembled. Recommended twice a year in our water, more if you have heavy tree cover.

Equipment watch

We look at the pad every visit and log pressure, leaks and noise. We are not a licensed pool contractor, so when something needs repair we put it in writing and hand you to one we trust. No markup, no finder fee.

Post storm cleanup

After a named storm we work our own customers first, then everyone else. Debris out, water rebalanced, filter cleaned and a follow up visit once the pool settles. Published rate all year, and it does not go up because a storm just came through.

Snowbird watch

Heading north for the season? We keep the pool running and the water clear while the house is empty, and send you the report every week so you can see it.

How we start

Three steps and you are on the route.

You send the details

Address, a couple of photos of the pool and the equipment pad, and whether it is screened. That is enough for us to price it.

We give you a firm monthly number

Same day, in writing. No teaser rate that climbs after month two, and no charge to come look at it.

First visit inside a week

Your assigned day gets set, your tech introduces himself, and the reports start showing up on your phone.

Not sure which one you need?

Send a photo of the pool. We will tell you straight, even if the answer is that you do not need us weekly.

Most Lehigh Acres and Fort Myers pools land between $135 and $175 a month. Where yours falls depends on size, tree cover and how much water there is to keep balanced. We give you one firm number in writing before we start.

Things that affect your price

Pool sizeA 10,000 gallon pool and a 25,000 gallon pool are not the same amount of chemistry
Tree coverOaks and palms over the water mean more netting time every single visit
Screened or openA cage changes what lands in the water and how the tile line behaves
Spa or water featuresSpas, waterfalls and sun shelves add surface area and chemistry
Salt systemSalt pools test differently and the cell needs watching
Condition when we startA pool that is already off when we take it on may need a corrective treatment or a recovery before weekly service can begin
Free on site evaluation, and the quote is in writingWe come look at the pool before we quote it, at no charge and with no obligation. Thirty minutes, and you get a firm monthly number the same day. We would rather price it right than guess low and come back asking for more.

Some pools need more

If your water is fighting a condition we cannot fix, like a pump that is not running enough hours, a repair that has been put off, a low water level or a surface holding algae, we add $25 a month while that condition lasts. We tell you before it starts, we show you the readings, and we take it off the month after it is resolved. It is never charged in the same month as a corrective treatment for the same problem.

Both owners are CPO certified through the Pool and Hot Tub Alliance, and every account is serviced by one of us or a tech we trained. Chemicals are included at every price. Repairs are not something we do, and we will tell you plainly when your pool needs one.

After a named storm

Hurricane cleanup, priced before the season starts.

A pool after a hurricane is not a pool that needs a cleaning. It is a tank full of branches, shingles, insulation and runoff, and it usually takes several visits to bring back. We publish both rates below year round so nobody has to wonder what it will cost while the power is still out.

Current weekly customers

Not a customer
From $675
Full cleanout, repeat visits until the water is swimmable, all recovery chemicals and a filter clean. Scheduled after our route customers are handled.

These are our published rates every day of the year, storm or no storm. We do not raise them during a declared state of emergency. If your pool needs work beyond cleaning, such as a pump or a screen enclosure, we will tell you and hand you to a licensed contractor.

Account and billing

How the money side works.

One flat monthly invoice, sent the same day every month. No surprise line items, and everything is spelled out before you pay it.

Your billing month

Invoice on the 1st

Emailed the first business day of the month, covering that month of service. Your rate is flat whether the month has four visits or five.

Due by the 10th

Pay from the link on the invoice with a card, your bank account, Apple Pay or Google Pay. Or set up AutoPay once and never think about it again.

Reports all month

After every visit you get readings, chemicals added and photos. That is your proof the work happened, not a promise.

Extra work billed separately

One time work like a filter clean or a green pool recovery is quoted first, approved by you in writing, then invoiced on its own. It never lands quietly on your monthly bill.

Ways to pay

Bank transfer (ACH)Straight from your checking account, and the easiest one to put on AutoPayNo added fee
Debit cardRun through the link on your invoiceNo added fee, ever
CheckMailed or left with your techNo added fee
Credit card, Apple Pay, Google PayVisa, Mastercard, Discover and Amex, plus the wallet on your phone3 percent surcharge, see below

About the credit card surcharge

Credit card payments carry a surcharge of 3 percent. That is less than what it actually costs us to accept a card, so we are not making anything on it. It appears as its own line on your invoice and you see the exact amount before you pay. We never surcharge debit cards, and it never applies to bank transfer, Apple Pay or Google Pay funded by a bank account, or check. If you would rather not pay it, put your account on AutoPay by bank transfer and it never comes up again.

The questions everyone asks

Account housekeeping.

Am I locked into a contract?

No. Service is month to month. Give us notice before the 1st and the next month simply does not bill. Notice after the 1st runs through the end of that month.

Can I pause while I am up north?

Yes. Snowbird accounts can drop to a reduced seasonal rate instead of cancelling, so your spot on the route is still there in November.

What if a visit gets rained out?

We still come. Rain does not stop pool service in Florida, and lightning only delays it. If we truly cannot get to you, we make the visit up later that week where it is practical.

Do you charge extra for chemicals?

Never on a weekly plan. Chemicals are in your monthly rate, including the heavy summer months when a pool eats twice the chlorine.

What happens if I pay late?

We call you before anything else happens. Service continues through a late payment, and we only pause a route stop after a full month unpaid.

Can I get a receipt for taxes?

Yes. Rental and investment property owners can request a year end statement of every invoice paid, any time in January.

How do you handle my card details?

We never see them. Payments run through Stripe, the same processor behind a great deal of online checkout, and your card or bank details are stored with them rather than with us. We see that you paid, not how.

How long does a payment take to clear?

Card and wallet payments post the next business day. Bank transfers take about five to seven business days, which is normal for ACH. Either way your invoice shows as paid straight away, so a slow bank transfer will never make you look late.

Questions about your invoice?

Call and you get a person who can actually open your account, not a ticket number.

Insurance and scope

Florida LLC with a Lee County business tax receipt. We carry commercial insurance appropriate to the services we perform, including general liability. A current certificate is available on request.

We are a pool cleaning and water care service. We are not a licensed pool contractor and we do not perform equipment repairs.

Legal

Residential Pool Service Agreement

These are the terms every Good Mood Pools customer agrees to. Nothing here is a surprise on your first invoice. Section 3 explains the limits of what we are legally permitted to do, and Section 7 limits our liability.

Version 1.2  •  Effective September 15, 2026
Please read this agreement in full before signing. Section 3 explains the limits of what we are legally permitted to do. Section 7 limits our liability and contains a waiver of certain claims. Those two sections affect your rights.

1. The Parties and the Property

This Residential Pool Service Agreement and Terms of Service (the "Agreement") is entered into between Good Mood Pools, LLC, a Florida limited liability company ("Good Mood Pools," "we," "us," or "our"), and the customer identified above ("Customer," "you," or "your"). This Agreement governs all pool and spa maintenance services we perform at the service address listed above.

2. Scope of Work

2.1 Weekly maintenance service

We provide recurring weekly residential pool maintenance. Each regular service visit includes the following tasks, performed as conditions require:

  • Testing the water, including sanitizer level, pH, total alkalinity, calcium hardness, stabilizer, and salt level where a salt system is present
  • Adding sanitizer, balancing chemicals, and algaecide as needed to bring the water into range
  • Skimming the water surface and netting debris from the floor
  • Brushing walls, steps, benches, and the accessible tile line
  • Vacuuming the pool floor as needed
  • Emptying skimmer baskets and the pump basket
  • Emptying the automatic cleaner bag or canister where one is present
  • Visually inspecting accessible equipment for obvious leaks, unusual noise, or visible failure
  • Backwashing or rinsing the filter as needed on sand and DE systems
  • Logging the visit and reporting any problems we observe

2.2 Chemicals included

Standard maintenance chemicals are included in your monthly rate at no additional charge. This covers routine sanitizer, balancing chemicals, and preventive algaecide used in the normal course of weekly service. Specialty treatments and remediation chemicals are not included and are quoted separately under Section 3.4.

Chemicals included in your monthly rate are those required to maintain a pool that is being operated as described in Section 4. If the water requires corrective treatment because of a condition outside normal weekly maintenance, including a pump or timer that has not been running, a low water level, a repair you have declined or delayed, chemicals added by anyone other than us, heavy bather load, storm debris or runoff, construction or tree work at the property, or a pool that has been drained or refilled, the additional chemicals and visits are a corrective treatment billed under Section 3.4. We will show you the readings, tell you what it will cost, and get your approval in writing before we begin. Where the condition is ongoing rather than a one time event, Section 5.8 applies instead.

Weekly service customers receive one corrective treatment each calendar year at no charge. The allowance covers our labour and the corrective chemicals for that visit and one return visit. It does not carry over to the following year, and it does not apply to green pool recovery under Section 3.5 or to storm cleanup under Section 7.10.

Water that goes off because of ordinary Florida weather on a pool that is running properly is not a corrective treatment. That is what your monthly rate is for.

2.3 Filter service

Cartridge filter elements are removed and rinsed approximately every 4 months as part of your regular service. A complete filter tear down, DE grid cleaning, chemical soak, or element replacement is a separate billable service under Section 3.4 and requires your approval in advance.

2.4 Service day and schedule

We service your pool on a regular weekly rotation. Your service day may shift because of holidays, weather, route changes, or staffing. We service in light rain. Lightning, heavy rain, high wind, flooding, or any condition our technician judges unsafe may cause us to reschedule or skip a visit. Where it is practical we make up a missed visit later in the same week. Your monthly rate is not reduced for visits missed due to weather or safety conditions. See Section 5.2.

2.5 Access without you present

You do not need to be home for service. We will service the pool as long as we have safe, unobstructed access to the pool area on your scheduled day. See Section 4 for your access responsibilities.

2.6 Service records

Every visit is logged in our service software. You receive a record of the visit that includes chemical readings, chemicals added, tasks completed, technician notes, and photos where relevant. These records are our documentation of the work performed.

3. Limitations on Scope

3.1 We are not a licensed pool contractor

Cleaning and maintenance of residential swimming pools and spas does not require a contractor license in the State of Florida. Repair, replacement, and installation of pool equipment does. Good Mood Pools is not a licensed swimming pool and spa servicing contractor, and we do not perform any work that requires that license. This limit is not a matter of preference. We are legally required to stay within it.

3.2 Work we do not perform

The following are outside our scope of work under this Agreement:

  • Repair or replacement of pumps, motors, filter housings, heaters, salt cells, chlorinators, automation systems, timers, or pool lights
  • Installation of any new pool equipment
  • Plumbing repairs, valve repair or replacement, leak detection, and leak repair
  • Any cleaning or servicing that requires partial or complete disassembly of equipment, other than routine filter cleaning
  • Interior surface work, including resurfacing, replastering, tile and coping repair, and crack repair
  • Acid washing, chlorine washing, or any work requiring the pool to be drained
  • Draining the pool in whole or in part for repair or renovation
  • Screen enclosure, deck, fence, or landscape lighting repair
  • Landscaping, deck pressure washing, and roof or gutter cleaning
  • Any service to a pool that is not the pool identified above

3.3 Referrals for work outside our scope

When your pool needs work we are not permitted to perform, we will tell you in writing and, if you would like, refer you to a licensed contractor we trust. Any work of that kind is a direct agreement between you and that contractor. The contractor bills you directly. We do not mark up, invoice, or collect payment for licensed contracting work, we do not supervise it, and we do not warrant it. We are not responsible for that contractor's work, pricing, scheduling, or conduct.

3.4 Additional services available at extra charge

The following are available to you but are not covered by your monthly rate. Each is quoted and approved in writing, which includes text message or email, before we begin:

Where a quoted job needs more time than the quote covered, additional time is billed at $85 per hour. If the work cannot be finished in the visit, we tell you where it stands and schedule a further visit only with your approval.

  • Filter tear down, deep clean, DE grid cleaning, or chemical soak
  • Corrective treatment when the water needs more than routine chemicals, as described in Section 2.2
  • Green pool recovery and algae remediation
  • Extra visits requested outside the weekly schedule
  • Storm cleanup and heavy debris removal following a named storm or severe weather
  • Stain identification and treatment, phosphate treatment, and metal sequestering
  • Tile line calcium and scale removal
  • Cleanup following construction, roofing, landscaping, or tree work at the property
  • Coordinating a drain and refill performed by a licensed contractor

3.5 Green pool recovery

A pool that has turned green, cloudy, or unswimmable is a recovery job, not routine maintenance, and it is billed separately. Recovery is a step beyond the corrective treatment described in Section 2.2, and it applies when the pool is no longer swimmable. Recovery requires additional visits, additional chemicals, and often filter service. We give you an estimate before we start. Because results depend on filtration, circulation, surface condition, and weather, we cannot guarantee a specific timeline or a specific outcome.

4. Customer Responsibilities

Water chemistry is a shared job. Several of the things that keep a pool clear are under your control, not ours. By signing this Agreement you agree to the following.

4.1 Access

You will provide safe, unobstructed access to the pool area on your scheduled service day, including an unlocked gate, a working gate code, or a key. If we arrive and cannot access the pool, that visit counts as completed and no credit is issued. After two consecutive no-access visits we will contact you. Continued lack of access is grounds for suspension or termination under Section 6.4.

4.2 Pets

Dogs and other pets must be secured and away from the pool area on your service day. Our technicians will not enter a yard with a loose dog. That visit is treated as a no-access visit under Section 4.1.

4.3 Circulation and equipment operation

You are responsible for running your circulation system enough hours each day to keep the water turning over, and for the electricity to do it. We recommend a minimum of 6 hours per day in cooler months and 8 hours per day from May through October. Chemicals cannot work in water that is not moving. If your pump, timer, or automation is not running, we cannot guarantee water clarity or balance regardless of what we add.

4.4 Water level

You are responsible for keeping the water level at roughly the middle of the skimmer opening. Water that is too low can prevent us from servicing the pool and can damage a pump that runs dry. Damage caused by a low water level is not our responsibility.

4.5 Repairs

When we report an equipment problem, you are responsible for having it repaired promptly by a licensed contractor. If you decline or delay a repair we have recommended in writing, we are not responsible for the condition of the water that results, and we may suspend service under Section 6.4.

4.6 Notice of changes

Please tell us in advance about anything that affects service, including new pets, changed gate codes, construction or landscaping work at the property, a party or heavy use, a pool that has been drained or refilled, new equipment installed, and any chemicals or treatments added by anyone other than us.

4.7 Chemicals added by others

Please do not add chemicals to the pool between visits without telling us. Chemicals added by you, by a family member, or by another service can conflict with our treatment plan and can cause staining, scaling, or an unsafe sanitizer level. We are not responsible for water conditions caused by chemicals we did not add.

4.8 Pool safety

You own the pool and you are responsible for its safety. That includes barriers, fences, self-closing and self-latching gates, door and pool alarms, safety covers, and compliance with the Florida Residential Swimming Pool Safety Act and any applicable Lee County requirement. We are not a pool safety inspector, and nothing in this Agreement makes us responsible for the safety of your pool area or for supervising anyone who uses it.

5. Fees, Billing, and Payment

5.1 Monthly rate

Your service rate is a flat monthly amount of the monthly rate stated in your service agreement, billed in advance on the 1st of each month for that month of service. It is a monthly rate for the maintenance program described in Section 2. It is not a per visit charge.

5.2 Four week and five week months

Your monthly rate is an annual service figure divided into twelve equal payments. Some months contain four service weeks and some contain five. There is no additional charge in a five week month and no credit in a four week month. Visits missed because of weather, a holiday, or lack of access are not prorated or credited.

5.3 Payment methods and card surcharge

We accept bank transfer (ACH), check, debit card, credit card, and digital wallets including Apple Pay and Google Pay. Automatic payment with a bank account or card on file is our preferred method and the easiest way to keep your account current.

A surcharge of 3 percent applies to payments made by credit card. This surcharge is not greater than our cost of accepting the card, it is disclosed to you before you pay, and it appears as a separate line item on your invoice and your receipt. No surcharge is applied to debit cards, prepaid debit cards, bank transfers, checks, cash, or to a digital wallet funded by a bank account. Payments are processed by our billing provider and its payment processor. We do not store your card or bank details ourselves.

5.4 Late payment

Invoices are due by the 10th of the month. We do not charge late fees. If your account reaches 30 days past due we may suspend service until the balance is brought current, and we will contact you before we do. Suspended service does not end this Agreement, and a pool that declines during a suspension may require a corrective treatment under Section 2.2 or a recovery charge under Section 3.5 before regular service resumes.

5.5 Returned payments

A returned check or failed bank transfer is subject to a fee of $35, to the extent permitted by Florida law.

5.6 Rate changes

We may adjust your monthly rate with at least 30 days written notice to you. Continuing service after the effective date of a rate change means you accept the new rate. If you do not accept it, you may cancel under Section 6.2 without penalty.

5.7 Charges that are not ours

Water, electricity, equipment repairs performed by others, and any permits or inspections required at your property are your responsibility and are not included in your rate.

5.8 Condition surcharge

Some pools require more chemical than normal weekly service because of a condition at the property that we cannot correct ourselves. That includes a pump, timer, or automation that is not running enough hours, an equipment repair we have recommended in writing that has not been made, a chronically low water level, a failing or rough interior surface that holds algae, high metal or mineral content in your fill water, and sustained heavy use of the pool.

Where one of those conditions exists, we add a condition surcharge of $25 per month to your rate for as long as the condition lasts. Before the surcharge begins we will tell you in writing what the condition is, show you the readings that support it, and tell you what would resolve it. The surcharge starts at the beginning of the next billing cycle after being notified. This is an exception to the 30 day notice period in Section 5.6. If you do not accept the surcharge you may cancel under Section 6.2 without penalty.

We remove the surcharge in the month after the condition is corrected. You do not have to ask us to remove it. We will not charge a condition surcharge and a corrective treatment under Section 2.2 in the same month for the same condition.

6. Term, Cancellation, and Suspension

6.1 Term

This Agreement begins on the service start date in your service agreement and continues month to month until it is cancelled by you or by us. There is no minimum contract length and no cancellation penalty.

6.2 Cancellation by you

You may cancel at any time by written notice, which includes email or text message to the contact information on your invoice. Notice received before the 1st of a month ends service at the end of the current month, and the next month is not billed. Notice received on or after the 1st ends service at the end of that month. Service continues through the end of any period you have already paid for. We do not issue refunds for partial months.

6.3 Seasonal suspension

If you are away for part of the year, we offer a reduced seasonal rate that keeps the pool from turning over while you are gone and holds your place on the route. We do not offer a full pause with no service. If service stops entirely, we cannot guarantee your service day when you return, and a recovery charge under Section 3.5 is likely.

6.4 Cancellation or suspension by us

We may suspend or cancel service, with notice where it is practical and immediately where safety is involved, for any of the following:

  • Nonpayment or repeated late payment
  • Repeated inability to access the pool area
  • An unsafe condition at the property, including a loose or aggressive dog, unsafe electrical equipment, or an unstable deck
  • A recommended repair you have declined that makes proper service impossible
  • Abusive, threatening, or harassing conduct toward our staff
  • A pool condition that makes weekly maintenance impractical until it is corrected

7. Limitations and Liability Waiver

This section limits our liability to you and waives certain claims. Please read it carefully before you sign.

7.1 Pre-existing conditions

We are not responsible for any condition that existed before our service began, including staining, etching, discoloration, rough or failing plaster, cracks, calcium scaling, tile loss, worn or aging equipment, undersized equipment, or improper original construction or installation.

7.2 Equipment failure

Pool equipment wears out and fails. In the normal course of service we operate valves, timers, filters, and cleaners. We are not responsible for the failure of equipment that fails during normal operation, is at or near the end of its service life, or was defective, undersized, or improperly installed. This applies to any part of the pool, the equipment, or their fittings that fails while being operated, opened, or handled in the ordinary course of service, including skimmer lids, baskets, valve handles, light fixtures, ladder and handrail hardware, drain covers, and cleaner hoses. It does not apply where the failure is caused by our own negligence or willful misconduct. Our reporting of an equipment problem is a courtesy, not an inspection, and it is not a warranty that we will identify every problem or identify it in time to prevent failure.

7.3 Water chemistry outcomes

Water chemistry is affected by conditions we do not control, including rainfall, heat, sunlight, storm runoff, the number of people using the pool, how many hours the pump runs, the quality of your fill water, landscaping and tree debris, animals, and the condition of your equipment. We use commercially reasonable care and industry standard practice, but we do not guarantee that the water will be free of algae, cloudiness, staining, or scaling at all times.

7.4 Staining, surfaces, and chemical effects

Chemicals applied correctly can still react with metals in fill water, with existing surface conditions, and with products added by others. We are not responsible for staining, etching, bleaching, or discoloration of pool surfaces, tile, grout, decking, screen enclosures, or landscaping, except where it results from our gross negligence or willful misconduct.

7.5 Use of the pool and waiver of claims

You acknowledge and agree that Good Mood Pools does not supervise the use of your pool or spa, does not provide lifeguard or attendant services, does not inspect or certify barriers, fences, gates, alarms, covers, or drain covers, and does not warrant that your pool is safe for use. Our presence at the property on a service day does not make the pool safe and does not shift responsibility for it to us.

To the fullest extent permitted by Florida law, you assume all risk arising from the use of the pool and spa by you, your family, your guests, your tenants, and anyone else at the property, and you release and waive any claim against Good Mood Pools, LLC and its owners, employees, and agents arising from that use. This waiver does not apply to a claim caused by our own negligence or willful misconduct.

7. Limitations and Liability Waiver, continued

7.6 Chemical handling and re-entry

We transport, store, and apply pool chemicals in accordance with manufacturer instructions, and we carry commercial insurance for that work. After any shock treatment or heavy chemical application, we will leave written notice of how long to stay out of the water. You agree to keep people and pets out of the pool for the period stated in that notice. We are not responsible for injury, irritation, or property damage that results from failure to follow a re-entry instruction we have given you.

7.7 Property and access

We use reasonable care while on your property. We are not responsible for damage to gates, latches, hinges, screens, decking, pavers, irrigation lines, or landscaping that results from pre-existing wear, deferred maintenance, or normal use. Any claim of property damage caused by us must be reported in writing within five business days of the service visit, with photographs, so that we can investigate while the facts are fresh.

7.8 Limitation of damages

Except for claims of bodily injury, and to the fullest extent permitted by Florida law, our total liability to you for any claim arising out of or related to this Agreement is limited to the lesser of the total amount you paid us for service during the twelve months preceding the claim, or the reasonable cost to repair or replace the damaged item. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of use of the pool, cost of water or electricity, rental income, or the cost of alternate service.

7.9 Indemnification

You agree to indemnify, defend, and hold harmless Good Mood Pools, LLC and its owners, employees, and agents from any claim, loss, or expense, including reasonable attorney fees, arising from the use of the pool or spa by you or by anyone at the property, from your failure to maintain required safety barriers or equipment, or from your instruction to perform service in a manner contrary to our written recommendation. This does not apply to the extent a claim is caused by our own negligence or willful misconduct.

7.10 Weather and events beyond our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including hurricanes and tropical storms, flooding, lightning, power or water outages, boil water notices, chemical supply shortages, public health orders, and road closures. After a named storm we resume service as soon as it is safe to do so. Cleanup beyond normal weekly maintenance is billed under Section 3.4.

We do not perform routine weekly service on a pool that is full of storm debris. Heavy debris damages our equipment, cannot be removed with weekly service tools, and makes water chemistry pointless until it is out. Where we find that condition we will tell you, and we will resume regular service once the pool has been reasonably cleared, either by you or by us under our post storm cleanup service. If we have told you in writing that the pool needs storm cleanup and you decline both that service and clearing it yourself, we are not obligated to perform weekly service while the condition lasts, and your monthly rate continues to apply under Section 5.2.

7.11 Insurance

We carry commercial insurance appropriate to the services described in this Agreement, including general liability coverage. A current certificate of insurance is available to you on request. Our insurance does not cover the failure of your pool equipment from age, wear, or prior condition.

7.12 No other warranties

We provide the services described in this Agreement in a workmanlike manner. Except as expressly stated here, and except for any warranty that cannot be disclaimed under Florida law, we make no warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

8. General Terms

8.1 Photos and service records

We photograph pools as part of routine service documentation. We may use before and after photographs of your pool in our marketing, without identifying you or your address, unless you tell us in writing that you prefer we do not. Please make your choice in the box below. If you choose not to, it changes nothing else about your service.

8. General Terms, continued

8.2 Communication

You agree that we may contact you about your service at the phone number and email address you give us, including visit reports, schedule changes, invoices, and payment reminders.

Text messages are covered by our Text Message Terms, published on our website. Message frequency varies, message and data rates may apply, and you may reply STOP at any time to stop receiving them. Consenting to text messages is not a condition of this Agreement or of any service we provide. You can give or decline that consent using the box in the signature section below, or on the quote form on our website, and you can change your mind at any time. If you opt out we will need another reliable way to reach you about service.

We do not sell your information, and we never share your mobile number or your text message consent with third parties for their marketing. Our Privacy Policy explains what we collect and why.

8.3 Our technicians

Our technicians work for us. You agree not to hire or engage any Good Mood Pools technician to perform pool service for you directly, whether as an employee or a contractor, while they work for us and for twelve months afterward.

8.4 Assignment

We may assign this Agreement, including in connection with a sale or transfer of all or part of our service route. You may not assign this Agreement without our written consent. If you sell the property, this Agreement ends on the closing date, and the new owner is welcome to start a new agreement with us.

8.5 Entire agreement and changes

This Agreement is the entire agreement between us regarding pool service at the property and replaces any prior discussion, quote, or understanding. We may update these terms with 30 days written notice. Continuing service after the effective date means you accept the updated terms.

8.6 Severability

If any provision of this Agreement is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest of the Agreement remains in effect.

8.7 Governing law, venue, and attorney fees

This Agreement is governed by the laws of the State of Florida. Any dispute will be brought in the state courts located in Lee County, Florida. In any action to enforce this Agreement, the prevailing party is entitled to recover reasonable attorney fees and costs.

8.8 Notices

Written notice under this Agreement may be given by email or text message to the contact information each party has provided, or by mail to the addresses above. Notice is effective when sent.

8.9 Electronic signature

An electronic signature, a digital acceptance, or a scanned copy of a signed page has the same effect as an original signature.

9. Acknowledgment

By signing below, you confirm that you have read this Agreement in full, that you have had the opportunity to ask questions about it, that you understand the scope limits in Section 3 and the liability limits and waiver in Section 7, and that you agree to be bound by these terms.

Privacy

Privacy Policy

What we collect, why we collect it, and what we never do with it.

Last updated September 10, 2026
The short version: we collect what we need to service your pool and bill you for it, we do not sell your information to anybody, and we never share your text message opt-in or consent with anyone.

1. Who we are

Good Mood Pools, LLC is a residential pool cleaning and water care service based in Lehigh Acres, Florida, serving Lee County. You can reach us at (239) 499-4770, info@goodmoodpools.com, or by mail at P.O. Box 1213, Lehigh Acres, FL 33970. This policy covers this website and the service we provide to customers.

2. What we collect

When you ask us for a quote or become a customer, we collect:

  • Your name, service address, and billing address if it is different
  • Your phone number and email address
  • Details about your pool, including size, type, equipment and photos you send us
  • Gate codes or access notes you give us
  • Service records we create, including chemical readings, work performed, technician notes and photographs of your pool
  • Payment information, which is handled by our payment processor and is not stored by us

This website uses a Google Ads tag and cookies so we can tell which of our ads bring people to the site. When you send a form, the tag reports that a form was sent and may include a scrambled (hashed) copy of your email address so Google can match it to an ad click. We never send your phone number for this.

If you reached us from a Google ad, the phone number shown on the site may be a Google forwarding number. It rings straight through to us and lets us see that the call came from an ad.

This site also loads its typefaces from Google Fonts, which means Google receives the request for those files. You can block or clear cookies in your browser at any time.

3. Why we use it

We use your information only to run the service you asked us for:

  • To prepare and send you a quote
  • To schedule and perform your pool service
  • To send you service reports, schedule changes and updates
  • To invoice you and take payment
  • To keep records of the work we performed
  • To answer you when you contact us

We do not build a profile of you. Other than measuring whether our ads are working, as described in Section 2, we do not use your information for advertising.

4. Text messages and your mobile number

If you give us your mobile number and agree to text messages, we use it to send you the messages described in Section 12 of this policy and in our Text Message Terms.

  • Customer data is not shared with 3rd parties for promotional or marketing purposes.
  • Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

You can stop text messages at any time by replying STOP to any message from us.

If you have questions about these text messages, contact us at info@goodmoodpools.com or call (239) 499-4770.

5. Who else sees your information

We do not sell, rent, trade, or otherwise transfer consumer data to external organizations for their own use, even with your consent. The only exceptions are:

  • Contracted service providers that process information on our behalf only as strictly necessary to deliver our service, such as our phone and messaging provider, website host, scheduling software, and payment processor. They are bound by confidentiality and non-use obligations and may not use your information for any purpose of their own.
  • Google, acting as our service provider for the ad measurement described in Section 2, under its data processing terms. Google receives only a scrambled (hashed) email address, never your phone number.
  • Disclosures the law requires, such as a valid legal request, or to defend a legal claim.

If you ask us to refer you to a licensed contractor, we give you the contractor's contact information so you can reach out directly. We do not pass your information to them.

That is the whole list.

6. Photographs

We photograph pools as part of routine service documentation, and those photographs are part of your service record.

We may use before and after photographs of a pool in our marketing without identifying you or your address. You can decline this, and there is a box for exactly that in Section 8.1 of the service agreement. You can also tell us at any time and we will stop.

7. How long we keep it

We keep customer records for as long as you are a customer, and afterward for as long as we need them for tax, accounting and legal reasons.

If you ask us to delete your information and we are not required to keep it, we will.

8. Your choices

You can, at any time:

  • Ask what we hold about you
  • Ask us to correct something that is wrong
  • Ask us to delete your information, subject to Section 7
  • Stop text messages by replying STOP
  • Ask to be contacted a different way
  • Tell us not to use photographs of your pool

Call or email us and we will take care of it. We will not charge you for it and we will not make it difficult.

9. Keeping it safe

We protect your information against unauthorized sharing with access controls, contractual limits, and internal privacy and security procedures:

  • Only the people who need your information to do the work can see it, and our business accounts are password protected.
  • Our service providers are contractually limited to using your information only to provide their service to us.
  • We keep only the information we need, and we remove access when someone leaves our team.

No system is perfect, and we will not pretend otherwise, but we take these steps seriously.

10. Children

This website and our service are for adults. We do not knowingly collect information from anyone under 18.

11. Changes

We may update this policy. The date at the top shows when it last changed.

12. Good Mood Pools Messaging Terms and Conditions

Text Message Terms

How we use text messaging, and how to stop it at any time.

Last updated September 10, 2026
You will never be added to our text messages without asking for them. Consent is optional, it is never a condition of getting a quote or of buying anything from us, and you can stop at any time by replying STOP.

At a glance

  • Program: Good Mood Pools customer service text messages from (239) 499-4770.
  • Message types: replies to quote requests and questions, service day confirmations and schedule changes, service reports, notices about something we find at your pool, invoices, payment reminders and receipts, and customer support responses.
  • Message frequency varies based on your service and communication needs.
  • Message and data rates may apply.
  • For help, reply HELP to any message, call (239) 499-4770, or email info@goodmoodpools.com.
  • Reply STOP to any message to unsubscribe.
  • Consent to receive text messages is not a condition of purchase.

1. What the program is

Good Mood Pools operates a text messaging program for customers and for people who ask us for a quote. Messages are sent from our business number, (239) 499-4770.

Messages are about your pool service and your account. That includes:

  • Replies to a quote request you sent us
  • Confirming your service day, or telling you it has moved
  • Service reports after a visit, including readings and photos
  • Letting you know about something we found at your pool
  • Invoices, payment reminders and receipts
  • Scheduling after a storm

These are informational messages about your own service and account. We do not send marketing or promotional text messages, and we do not send discount codes or offers by text.

Consenting to text messages is never a condition of purchase. You can opt out at any time using the instructions in Section 4.

2. How you join

You join only by asking to. There are four ways that happens:

  • Ticking the text message consent box on a form on this website. There is also a box to decline text messages altogether
  • Telling us in writing, including by email or text, that we may text you
  • Signing a service agreement where you have agreed to text contact
  • Texting us first at (239) 499-4770 from your own phone

Ticking the box on our website is optional. Every form on this site can be submitted without it, and leaving it unticked has no effect on your quote or your service.

Consent to receive text messages is never a condition of buying any service from us.

3. How often and what it costs

Message frequency varies. Most customers get roughly one message per service visit, plus anything that comes up at your pool. We do not send a fixed number per month.

Message and data rates may apply. Those are charged by your mobile carrier, not by us. We do not charge you anything to receive our messages.

We send messages between 8:00 am and 9:00 pm in your local time, other than a genuine emergency affecting your property.

4. How to stop, and how to get help

Reply STOP to any message from us and we will stop texting that number. You may also reply UNSUBSCRIBE, CANCEL, END or QUIT. You will get one message confirming that you have been removed, and then nothing further.

Reply HELP to any message and we will reply with our name and how to reach us. You can also call or email us at (239) 499-4770 or info@goodmoodpools.com.

You can also ask us to stop by calling, emailing, or telling your technician.

Opting out of text messages does not cancel your pool service. If we can no longer reach you by text, we will need another reliable way to contact you about your service, so please tell us how you would like to be reached.

5. Carriers and delivery

Text messages depend on your mobile carrier's network. Carriers are not liable for delayed or undelivered messages, and neither are we. If something is urgent, call us at (239) 499-4770 rather than relying on a text.

Not every handset or carrier plan supports every kind of message. Picture messages in particular may not arrive on some plans.

6. Your information

We use your mobile number to contact you about your service, including the messages described above, and for nothing else.

  • Customer data is not shared with 3rd parties for promotional or marketing purposes.
  • Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

See our Privacy Policy for the full picture of what we collect and why.

7. Changes

We may update these terms. The date at the top shows when they last changed. If we change them in a way that materially affects your messages, we will tell you before it takes effect.
